You may opt-out of receiving all SMS/TEXT messages from eTags at any time by replying to one of Our SMS/TEXT messages with any of the following words “STOP,” “ARRET,” “CANCEL,” “END,” “OPT-OUT,” “OPTOUT,” “QUIT,” “REMOVE,” “TD,” “UNSUBSCRIBE” from the mobile device receiving the messages.

You may also send an email to privacy@etags.com to stop any or all of SMS/TEXT messages, emails, and telephone calls from being sent to You by eTags. If You choose this option, You must include Your cellular phone number or You may continue to receive SMS/TEXT messages and calls.

You may also email Customer Service at support@etags.com to opt out of receiving certain or all communication from eTags.

While We respect Your decision to opt-out, You agree and understand that opting out of receiving all SMS/TEXT messages, emails, and calls will impact Our ability to service You and that You will not receive registration renewal or other reminders.

You may unsubscribe from any of our e-mail marketing programs at any time. In every e-mail communication we send, there is an unsubscribe hyperlink that allows the recipient to unsubscribe from that specific marketing program by simply clicking the hyperlink provided and following the instructions provided. We attempt to process all unsubscribe requests in a prompt fashion. However, after unsubscribing, we cannot guarantee that you will never receive another mailing from us, because we may obtain your e-mail address in the future through a different e-mail marketing program that you have opted into. eTags reserves the right to provide aggregate or group data about eTags users for lawful purposes. Aggregate or group data is data that describes the demographics, usage, or characteristics of eTags participants as a group, without disclosing personally identifiable information. By opening an eTags account, you agree to allow eTags to provide such aggregate data to third parties. By agreeing to these terms, you hereby consent to the disclosure of any record or communication to any third party when eTags, in its sole discretion, determines the disclosure to be appropriate. Additionally, when you open, preview or click on the advertising portion of our e-mails and/or those of our marketing partners and/or affiliates of eTags, you have agreed to the terms set forth in our Privacy Policy, and agree that as a function of opening, previewing or clicking on the advertising portion of our e-mails, that you will receive new or additional marketing communications from us, our marketing partners and/or affiliates of eTags.

Legal Requests / Questionable Activities
We will cooperate with law enforcement inquiries, as well as other authorized third parties to enforce laws, such as: intellectual property rights, fraud and other rights, and to help protect you from bad actors. Therefore, in response to a verified request by law enforcement or authorized government official relating to a criminal investigation or alleged illegal activity, we can (and you authorize us to) disclose your name, city, state, telephone number, email address, usage history, IP address, access times and fraud complaints. Notwithstanding the foregoing, when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss; or report suspected illegal activity, we will provide the necessary information as required to address the specific situation.

Further Release of Data
eTags also reserves the right to release current or past user information in the event that eTags believes that:1) the user is using, or has used, services of eTags in violation of the terms and conditions, to commit unlawful acts; 2) if the information is subpoenaed; 3) if eTags is sold or acquired; or 4) when eTags deems it necessary or appropriate including, without limitation, sharing your e-mail address with other third-parties for suppression purposes in compliance with the CAN-SPAM Act of 2003, as amended from time to time, and Federal Trade Commission enabling regulations.

In addition, by registering at the website, you agree that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR 310 et seq.), as amended from time to time (the "Rule"). Notwithstanding that your telephone number may be listed on the Federal Trade Commission's Do-Not-Call List, we retain the right to contact you via telemarketing in accordance with the Rule.

Data Security
To the extent that user credit card-specific information is collected by eTags and/or any of its affiliates and/or subsidiaries, said information will be kept in confidence and will not be shared with any third parties without the user's prior informed consent or a court order mandating release. Notwithstanding the foregoing, eTags, its affiliates and/or subsidiaries reserve the right to share with third parties the fact that they have credit card information on file for specific users but they will not share the specific credit card information with third parties without the user's prior informed consent.

We endeavor to safeguard and protect our users' information. When users submit information at the website, their information is protected both online and offline. The privacy of your personal information is very important to us. The servers in which we store personally identifiable information are kept in a secure physical environment. eTags has security measures in place to protect the loss, misuse, and alteration of personal information under our control. Further Limitation on Privacy

By way of example (without limiting the foregoing), third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect through the Network. Children

Third Party Users may receive e-mail confirming their registration with eTags, as well as promotional marketing of commercial products and services.

eTags does not endorse, nor is eTags responsible for the accuracy of, the privacy policies and/or terms and conditions of any of the advertisers and/or third parties accessible through the eTags website. However, we reserve the right to also allow other companies, called third-party ad servers or ad networks, to serve advertisements within our Network web pages. In addition, some of our advertisers may use the services of third-party ad networks. Some of these third-party ad networks may place a persistent cookie on your computer. Doing this allows the third-party ad network to recognize your computer each time they send you an online advertisement. Should You choose to make a donation through Our website, Your information, limited to Your name and email address, will be provided to the charity You chose. eTags Network may contain links to other websites. Once you select a link that takes you to another website, you are subject to the privacy policy of the website containing that page. We have no control over any information you choose to provide to those websites.

International Users
Personal data that you have voluntarily entered electronically is delivered to servers located in the United States. OUR RELATIONSHIP IS GOVERNED BY A MANDATORY, BINDING ARBITRATION AGREEMENT

The following "Terms of Use" are the terms which govern Your use of this website, and the offers, services, and/or products that are offered thru eTags.com, its parents, subsidiaries, or affiliates, collectively herein “eTags” (“Agreement”). Throughout this site, the terms “eTags,” “We”, “Us”, and “Our” refers to eTags. The offers on this site, the offer terms, including all information, tools, services, products, available from this site, to You, “the user,” is conditioned upon Your acceptance of all the terms, conditions, policies and notices stated herein, unless specifically excluded. eTags, the eTags website and all content contained therein is wholly owned and operated by eTags, Inc.

1. PAYMENT AND REFUNDS.

1.1. You agree to pay for any and all products and services that You purchase on Our site and You agree that We may charge Your credit card for them.

1.2. You agree to be charged the following fees to register Your vehicle or transfer Your title, and these fees apply to each vehicle:

1.2.1. State Fees and Taxes: We verify all of Your information including Your verification of insurance affidavit. Your fees are prepaid on Your behalf by Us. You hereby agree to pay and be charged for this amount. State transaction fees are unique and dependent on Your particular vehicle. In addition to State fees, You agree to pay and be charged the fees listed in the Fees section.

1.2.2 Credit Card Convenience Fee: We will charge a credit card convenience fee based on the portion of the State Fees and Taxes.

1.3. Return & Refund Policy: ALL SALES ARE FINAL.

1.3.1. Registration Renewals. Once We have transmitted funds on Your behalf to Your state Department of Motor Vehicles (“DMV”) or its equivalent, no cancellations, refunds or returns shall be accepted. We transmit fees to the state DMV immediately following Your payment submission. State fees and certain other Fees cannot be refunded under any circumstance.

1.3.2. Title Transfer (TurboTitle). Use of Our Title Transfer application is on a prepaid basis. You agree to pay to use the application, and further agree that the fee for using the application is non-refundable.

1.3.3 UCR Registration. Once your transaction is complete and payment is made on Your behalf, no refunds will be made.

1.4. You agree that Your transaction order will be sent to the shipping address You provided Us and that We will ship with USPS, if applicable. You agree that We are not responsible for non-delivery of Your order. You agree that shipping is not available weekends and holidays.

1.5. You hereby agree and understand that once We receive Your order that We are entitled to and have earned Our Service Fee as We have already performed services in verifying Your information and submitting fees to the state DMV. We are not responsible for incorrect information provided to Us by You or by others on Your behalf. We are not responsible for any delays on the part of the USPS or any courier service and We are not responsible for any lost, damaged or mutilated items.

1.6. Chargebacks: Any improper Chargebacks will be prosecuted to the fullest extent of the law, and You may be liable for statutory damages and attorney’s fees. Any improper chargebacks may subject You to criminal, and or civil penalties. We will report improper chargebacks to the appropriate authorities. 2.4. You also agree that We may send to You in electronic form any notices or other communications regarding this site, Our products and services. We can send You electronically any notices or other communications to the email address that You provided to Us during registration, or by posting any notices or other communications on this site. The delivery of any notices or other communications from Us is effective when sent by Us, regardless of whether You read such notice or other communication when You receive it or whether You actually receive the delivery. You can withdraw Your consent to receive such notices or other communications electronically as set forth above.

2.5. If You complete an order with Us on Our website, by typing Your name in the signature field provided in the final checkout process, You expressly agree to enter into a contract with Us electronically and all contracts entered into electronically will be deemed for all purposes to be in writing and legally enforceable as a signed agreement to these Terms & Conditions.

3. CHANGE OF ADDRESS. You hereby agree and understand that eTags cannot change Your physical address on Your vehicle record. You must contact Your local DMV office to make a change of address. No refunds can be provided to anyone once Your vehicle transaction has been processed. Please review Our return policy.

4. MINORS. You must be 18 years of age or older, or the lawful age of majority in the jurisdiction in which You reside, to access and use the eTags sites, purchase or use eTags products or services, and You hereby warrant that You are 18 years of age or older, or that it is lawful in the jurisdiction in which You reside to access this site and use the eTags product and services. if You are not 18 years of age or older and do not meet the above criteria please stop access to this site immediately.

5. ACCESS COSTS, EQUIPMENT AND SOFTWARE. You must provide at Your own expense the equipment and Internet connections that You will need to access this site. This site may require the use of certain third-party software. You are responsible for all costs associated with acquiring such software, if any, and complying with any licenses associated with such software. We are not responsible for any costs You incur to access or use this site.

If You cause a technical disruption of this site or the systems transmitting this site to You or others, You agree to be responsible for any and all losses, liabilities, expenses, damages and costs, including reasonable attorneys' fees and court costs, arising or resulting from that disruption.

14. MANDATORY, BINDING ARBITRATION; CHOICE OF LAW.

14.1 Any dispute, controversy, or claim arising out of or relating to Your use of eTags services or in any manner the relationship between You and eTags, including disputes related to eTags’ communications or the alleged breach by eTags of its contractual duties, shall be finally settled by binding arbitration in accordance with the Consumer Arbitration Rules the American Arbitration Association ("AAA"). To initiate arbitration proceedings, You must send a letter requesting arbitration and describing Your claim to Chief Legal Officer, eTags, 1650 SE 17th Street, Suite 300, Ft. Lauderdale, FL 33316. The arbitration of all disputes will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time the arbitration is commenced. The AAA rules are available at www.adr.org or by calling 1-800-778-7879. The arbitration of all disputes will be conducted by a single arbitrator, who shall be selected using AAA’s procedures. Any judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Any arbitration proceeding shall be conducted in the state in which your vehicle is registered. The arbitrator may award costs, and expenses of arbitration to the prevailing party but may not award attorney’s fees, punitive, or exemplary damages. You or We may only be awarded actual damages.

14.2. In any arbitration proceeding, to the extent permitted by AAA’s Rules, document discovery will be limited to those documents relevant and material to the outcome of disputed issues, and depositions will be permitted only in exceptional cases.

14.2. CLASS ACTION WAIVER. ALL PARTIES TO THE ARBITRATION MUST BE INDIVIDUALLY NAMED. THERE SHALL BE NO RIGHT OR AUTHORITY FOR ANY CLAIMS TO BE ARBITRATED OR LITIGATED ON A CLASS ACTION OR CONSOLIDATED ACTION BASIS OR ON BASES INVOLVING CLAIMS BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF OTHER PERSONS OR ENTITIES. NEITHER YOU, NOR ANY OTHER CUSTOMER, CAN BE A CLASS REPRESENTATIVE, CLASS MEMBER, OR OTHERWISE PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING AGAINST US.

14.3. In the event this mandatory, binding arbitration provision is deemed unenforceable for any reason, the foregoing class-action waiver shall apply to any proceeding brought in any court.

14.4. JURY TRIAL WAIVER. In the event of a permitted court proceeding, You hereby irrevocably waive Your right to a trial by jury.

14.5. This Agreement shall be construed and enforced in accordance with the laws of the state in which your vehicle is registered, without regard to any conflicts of laws provisions and without regard to where you access this site from. Invalidation of any one of the covenants or terms of this Agreement, by judgment of a court, shall not affect any of the other provisions of this Agreement which shall remain in full force and effect.

14.6. We recognize that it is possible for You to access this site from any jurisdiction in the world, and We have no practical ability to prevent such access. This site has been designed to comply with the laws of the United States. If any material on this site, or Your use of this site, is contrary to the laws of the place where You are when You access it, this site is not intended for You, and We ask You not to use this site. You are responsible for informing yourself of the laws of Your jurisdiction and complying with them.

15. AMENDMENT AND MODIFICATION. We reserve the right, in Our sole discretion, to change these Terms of Use at any time by posting revised terms on this site. Neither party shall be liable for service interruptions, delays, failure to perform, damages, losses or destruction, or malfunction of any consequence thereof caused or occasioned by, or due to fire, flood, water, the elements, acts of God, war, explosions, civil disturbances, governmental actions, shortages of equipment or supplies, unavailability of transportation, acts or omissions of third parties, or any other cause beyond the effected party’s reasonable control. The party so delayed or prevented from performing shall provide prompt notice of such event to the other party and shall exercise good faith efforts to remedy any such cause of delay or cause preventing performance.

17. INTEGRATION. This Agreement shall constitute the entire agreement between the parties with respect to the subject matter hereof and shall be deemed to merge all prior and contemporaneous agreements, communications and understandings (both written and oral).

18. MODIFICATION AND SEVERABILITY. No modification of this Agreement shall be binding unless in writing and signed by both parties. If any provision herein is held to be unenforceable, the remaining provisions shall remain in full force and effect. All rights and remedies hereunder are cumulative. Any provision of this instrument prohibited by law in any state shall, as to such state, be ineffective to the extent of such prohibition, without invalidating the remaining provisions of this instrument.

19. NOTICE. All notices, requests, demands, and other communications to Licensee hereunder shall be in writing and shall be deemed given at the time such communication is sent by registered or certified mail (return receipt requested), or recognized national overnight courier service, or delivered personally, to the following address (or other address as shall be specified by like notice and made to the attention of the Chief Legal Officer):

20. SURVIVAL. Any obligations which expressly or by their nature are to continue after termination, cancellation, or expiration of the Agreement shall survive and remain in effect after such happening.

Florida

ETAGS APPOINTMENT AS AGENT AND LIMITED POWER OF ATTORNEY. You hereby appoint eTags to act as Your agent and Attorney-in-Fact and grant eTags limited power of attorney for the limited purpose related to all matters in renewing Your vehicle transaction or vehicle tag transfer. eTags will submit Your transaction and any applicable fees to one of Our licensed, affiliated tag agency partners, and Your transaction will be processed by said licensed affiliated tag agency partners in accordance with the Laws of the State of Florida. You hereby grant this limited power of attorney to eTags via electronic signature at the time of checkout pursuant to the Electronic Signature Act of 1996 and specifically Fla. Stat. §668.004.

Any disputes resulting from Your use of Our services or site(s) shall be construed and enforced under the laws of the State of Florida. You hereby acknowledge and agree to the Mandatory, Binding Arbitration Clause contained herein. Any arbitration proceeding shall take place in the City of Ft. Lauderdale, Florida.

California

eTags provides Vehicle Transaction and Titling Services and is licensed and contracted under the CA DMV Business Partner Automation Program ("BPA"), herein referred to as the (BPA) with the Department of Motor Vehicles for the state of California (DMV). The DMV offers to the consumer the benefit of the BPA in an effort to provide better and faster service to the consumer. As a business partner, we may charge our customers for the option of expedited transaction processing and title transfers, transaction card, license plates and stickers, and all DMV services provided by us under California Vehicle Code §1685.

The CT DMV offers to the consumer the benefit of choosing to do business with its licensses to provide better and faster service to the consumer. As a Licensee, We may charge Our customers for Our services.

CT DMV Fees: We verify all of your information including your verification of insurance thru the CT DMV. The CT DMV provides us an exact amount for the fees and taxes to renew or transfer your vehicle registration including and late fees, etc. You hereby agree to pay and be charged for this amount. You further agree that we will collect and forward the amount assessed by the CT DMV for the transaction(s) selected by you including the CT DMV fees for information and services provided by CT DMV.

You agree that if items are required by the CT DMV to complete your vehicle registration or title transfer application you will provide those items if requested by us or CT DMV. You agree that orders placed after CT DMV hours will be processed the following business day. You agree CT DMV fees adjustments late fees, penalties, violations, will be added to Your credit card on file for this order, You agree that eTags may accept or reject your additional fees, late fees, penalties. You agree CT DMV may apply additional late fees and penalties or require proof of liability insurance, documents or other items to complete the CT DMV transaction. You agree We are not responsible for additional CT DMV late fees or penalties as result of the use of this website. Transactions processed through this website are consistent with all laws and regulations set forth by the State of Connecticut and CT DMV.

You hereby appoint eTags to act as Your agent and Attorney-in-Fact and grant eTags limited power of attorney for the limited purpose related to all matters in renewing Your vehicle transaction or vehicle tag transfer. eTags will submit Your transaction and any applicable fees to one of Our licensed, affiliated tag agency partners, and Your transaction will be processed by said licensed, affiliated tag agency partners in accordance with the Laws of the State of Louisiana. You hereby grant this limited power of attorney to eTags via electronic signature at the time of checkout pursuant to the Electronic Signature Act of 1996 and RS 9:2607.

Any disputes resulting from Your use of Our services or site(s) shall be construed and enforced under the laws of the State of Louisiana. You hereby acknowledge and agree to the Mandatory, Binding Arbitration Clause contained herein. Any arbitration proceeding shall take place in the City of Kenner, Louisiana.

Ohio

ETAGS APPOINTMENT AS AGENT AND LIMITED POWER OF ATTORNEY. You hereby appoint eTags to act as Your agent and Attorney-in-Fact and grant eTags limited power of attorney for the limited purpose related to all matters in renewing Your vehicle transaction or vehicle tag transfer. eTags will submit Your transaction and any applicable fees to one of Our licensed, affiliated tag agency partners, and Your transaction will be processed by said licensed, affiliated tag agency partners in accordance with the Laws of the State of Ohio. You hereby grant this limited power of attorney to eTags via electronic signature at the time of checkout pursuant to the Electronic Signature Act of 1996 and ORC 1306.06.

Any disputes resulting from Your use of Our services or site(s) shall be construed and enforced under the laws of the State of Ohio. You hereby acknowledge and agree to the Mandatory, Binding Arbitration Clause contained herein. Any arbitration proceeding shall take place in the City of Beachwood, Ohio.
