A lienholder can place a lien on a vehicle if they have financial interest in it. This prevents the car, SUV, truck, RV, or motorcycle from being sold until the lien is satisfied (paid off), or else the lienholder takes possession it.
If the lien isn’t paid or resolved with the lien holder, they have to request the title replacement (duplicate title). If the lien is satisfied, it could be removed by submitting the additional HSMV 82666 form along with other required documents and proof of lien satisfaction, such as a payment receipt.
The Florida Department of Highway Safety and Motor Vehicles keeps records of titles in two ways: paper and electronic. An electronic title is held electronically, so it can’t be lost or stolen since it doesn’t exist in paper form. But a paper title typically gets misplaced, lost, or damaged; that’s when a title replacement is needed.
If you have an electronic title, just ask eTags to print it out and mail it to you should you need to transfer ownership of your vehicle. If you have a paper title, just order a duplicate paper title.
There’s a possibility that after you receive your duplicate title, that you find the one you misplaced. Maybe you’re organizing some files and find it, or perhaps moving to a new home and discover it while packing boxes.
Please note that IF the original title is located after a title replacement was issued, the original is no longer valid since it was replaced. You should destroy the original title or forward it to the FLHSMV.
