Buying a privately owned vehicle from out of the state? Moving to Florida and taking your clunker, er, vehicle with you? Got hitched and changed your name? You are going to need to do a title transfer for your vehicle. As you can see, there are many reasons to transfer a title, and you’ll probably have to do it a few times during adulthood especially if your title gets lost, stollen or damaged.

Don’t worry, the Florida Department of Highway Safety and Motor Vehicles (DHSMV) makes the process easy… Just kidding! The DHSMV has plenty of things to worry about and making vehicle title transfers easier for people isn’t one of them. No worries, we’ll help you sort that all out with this quick guide (You’re welcome in advance).

The DHSMV requires Florida title transfers to be completed for the following situations:

  • Buying or selling a privately owned vehicle
  • Inheriting or donating a privately owned vehicle
  • Changing your name or address
  • You’re new to Florida and brought your clunker, er, vehicle with you

Buying or Selling a Vehicle

Steps & Forms Buying a Vehicle Selling a Vehicle
Transfer section on title completed Required – obtain from the seller Required – provide the buyer
If the paper title is not available, a duplicate can be ordered prior to the transfer or a request for a new paper copy and the transfer can be done in one transaction.
Complete form HSMV 82040 Required – fill out this form to provide all the necessary information for the transfer
Insurance Affidavit form HSMV 83330 Required – fill out this form to verify the vehicle is insured along with proof of insurance
Bill of Sale Obtain a completed (and preferably notarized) one from the seller Required – Provide a completed bill of sale to the buyer. Having it notarized is optional
Lien satisfaction document Obtain  a lien satisfaction document from the seller if possible otherwise you become financially responsible for any that do exist Provide the buyer with a lien satisfaction document or a lien-free title to ensure a smoother transition
Payment Required – pay fee to obtain an electronic or paper title (see above) and the fees to register & license your vehicle  
Tax Collector’s Office visit Required – take all the forms, proofs, and payments above to the tax collector’s office of the county where your new vehicle will be registered. The seller’s company is recommended. If you can, go with the buyer to make sure the process goes by smoothly and your vehicle is officially sold.

Transferring a Title for Other Reasons

Florida Title Transfer – Out of State

Title transfers for vehicles brought to Florida from another state, require the following steps to transfer the out-of-state title:

  • A completed application for Certificate of Title With/Without Registration form
  • The original out-of-state title of the vehicle
  • Proof of Florida insurance like an insurance card, certificate, or a completed Florida Insurance Affidavit
  • Verification of your VIN (vehicle identification number) by having a representative from the tax collector’s office verify it personally or having authorized personal complete form HSMV 82042
  • Payment of the title transfer fee (electronic of paper), New to FL vehicle fee (see above for both), and the costs to register and title your vehicle

Inherited vehicles

  • The original title (talk to your agent if you cannot find the original title).
  • Form HSMV 82040 (The Application for Certificate of Title With/Without Registration).
  • Payment to obtain a new electronic or paper title (see chart above)
  • Additional documents that can include a copy of the owner’s death certificate and/or copy of the will, trust, or court order.

Vehicles given as gifts or donations

  • Completely fill out a vehicle title transfer in the same manner as you would if you were buying or selling a motor vehicle.
  • Bill of Sale form or a Form HSMV 83330 (Florida Insurance Affidavit)

Change of name and address

  • Form HSMV 82040 (Application for Certificate of Title With/Without Registration)
  • Payment to obtain a new electronic or paper title (see chart above)
  • If needed, proof of your name change (marriage license or court order)

To change or update your address on other documents such as your registration and license, you complete this online or at your local county tax collector’s office.

Why Bills (Notices) of Sale are Important

As a seller, you are required to provide your buyer with a Bill or Notice of sale. This provides protection for both parties. By filing, sellers will protect themselves from any civil liability and violations if the buyer should get into an accident or park the vehicle illegally somewhere before the title transfer is complete. Once you file this form, the tax collector office will be updated immediately by marking the title of the vehicle or vessel in the system as sold. However, the status of ownership will not be updated until the new owner completes the title transfer process.

    I don’t have a title for my vehicle, it was lost. And i don’t have contact with the person i bought it from but i have current and past registrations and a bill of sale. what options do i have for active duty military to get a new title in my name?

      Thank you for your service! – Unfortunately, without the title and contact with the seller, transfer the title to your name will be difficult. You can consider obtaining legal counsel to see if their are any options you can take advantage of based on documentation you already have, like the Bill of Sale. You can also look into the “bonded title” process for which there are many private companies providing services. Best of luck.

      You have to assign the titles to each other so each one of you can apply for a title transfer and then register in fl. You must get fl insurance too, to get a registration/FL license plate. FL has a car sales tax of 6%. You can transfer title and register online with eTags

    I’m moving from Texas to Florida. I have 2 trailers and 3 vehicles. 1 trailer is registered in Texas but has no title since it was a homemade. The other trailer I just bought and have a signed title to transfer to my name would it be easy to transfer the title to my name in Florida or should I do the transfer in Texas? 1 vehicle is a Florida titled truck in my name from my dad passing and I’m bringing it back to Florida. I never titled or registered it in Texas so that should be easy right? The other truck is titled in my name in Texas do I have to transfer the title in order to register the truck? The other vehicle we just bought in November and it has a lien on it but has 2 year tags in Texas. I’m not sure what the best thing to do is honestly any help would be greatly appreciated.

      Hello, we should be able to process the homemade trailer with your registration. For Texas or FL question, it would be best to transfer in FL as it would just be one title fee.For the title in your name after your dad’s passing, Yes, however, we will most likely ask for supporting docs such as the death certificate , a Will if applicable, and letters of admin if applicable. Yes you still have to transfer your texas title fo fl plates.
      For the financed vehicle, we will need to request the title form the lienholder, in the meantime, a registration will be issued while the release of title is underway and in route to us. For all of these services, you can get online with eTags and choose Moving To FL as a service

      Our condolences for your loss.

      Your brother-in-law will need to check requirements with the NC DMV. They may accept the current FL title listing both you and your husband’s name with only your signature and a copy of his death certificate listing you as the spouse. They may require a court document such as those issued after a probate. Alternatively, they may require that the title be updated to remove your husband’s name before it can be transferred in North Carolina.

    My parents and I are residents of Florida. They want to gift me their car, but I currently reside in Chicago, IL, and in the future planning to get a driver’s license here as well. The car title and insurance are registered with my mom. What is the best way to proceed in gifting the car? Do I have to register the title on my name in Florida first, or I can do it directly in Illinois?

      Hello! Thank you for your question. If your parents have the title, and you’re a resident in IL, no need to transfer the title to Florida first! Simply have your parents sign the title over to you and obtain insurance. You can transfer directly to yourself in IL. Hope this helps!

    I am buying a car from an individual in Michigan. I currently have a car with a Florida license plate but an expired (more than a year) Florida registration. What is the process to transfer my current Florida plates to the new car? Will this require me to renew my current registration which has been expired? Will I have to get my VIN and Odometer verified in Michigan or Florida? Really appreciate your response.

      Assuming the Florida registration expired within the last year or two, you should be able to transfer the registration if you are registering the new car in Florida. (Please note, the total DMV fees for the the transfer registration will include any late/penalty fees owed.) A VIN Verification will be part of the process for transferring. If you wish to process the title and transfer online rather than in person in Florida, you can do so by placing an order on https://www.etags.com/app/fl?utm_source=blogquestion
      You would select Florida and then, from the Services drop down menu, choose “Transfer Title/Registration” which is the second from the last option and follow the directions.     I bought vehicle from Florida dealer (I’m co-buyer), I’m paid for it, I’m using it, I moved to Hawaii, vehicle is registered here. Buyer lives in Chicago – he don’t have anything with it, just that he’s name on the contract. Or it’s possible for him, to sign off Florida title for me, while he is in Chicago? Or it’s possible to do it by websites, or he will need to go to his local DMV ? How works that signing off? I was reading comments, but I’m not sure or it’s same document should by filled by Buyer as 8240 form? Or it’s enough to submit only that document? What he should write like a reason why he signing it off to me? Or Or it’s possible to send something for FL DMV before they released title for sending to him in Chicago only with his name? Maybe he could sign and send Power of attorney for them with request to write only my name on title? I also Somewhere I did find info about taxes.. But does he really will need to pay something?.. I just want to get title on my name (buyer agree) and sell vehicle. It was Bad investment. Sorry for messy letter, I’m new in English language, so many information in internet, but I don’t know where is the true. 🙂 Thank you!!!

    I would like to give a car to my friend who has neither Florida driver’s license nor car insurance. He is a international student, and he has a driver’s license in Japan but does not have international license. I will leave Florida soon and it seems difficult for my friend to get a FL driver’s license until I leave here. Could we successfully transfer the title at DVM?     Good morning. I recently bought a car and the seller provided me with a notarized Bill of Sale and we completed a POA form that was downloaded from the FL DMV site. The car has an electronic title and I would like to transfer the car under my name and get a paper title. Is the POA authorization and Bill of Sale sufficient for this operation?     If an individual inherits a vehicle with an open lien, but do not have credit/income sufficient enough to have the loan transfer into their name, and just wish to sell it, how do they go about selling the vehicle with just a death certificate?

    my scenario: I live in Palm Beach County Florida. I’m considering buying a car from a dealer in Broward County. The car was formerly on lease from the dealer, and now is for sale. As far as I know, the car was new before the lease. I am going to finance thru the manufacturer, so there will be a lien. Question: what are the charges for title and tag? The dealer quoted $400 plus $149 electronic filing = $549 in total.

      The title fee will be between $85 and $120. The registration fee will be in excess of $289.10 and increases based on the weight of the vehicle. You would need to ask the dealer for a breakdown to confirm the registration fees due for that vehicle

      No, you do not need to get the title transferred to you only in order to sell the vehicle. In order to sell the car, you need to know how to complete the seller’s portion on the front of the title. If the registered owners’ names on the title are joined by AND, then both owners would need to sign the title as seller and co-seller before giving it to the buyer to sign it as a purchaser; however, if the names on the title are joined by OR, then only one of the owners need to sign the title as a seller.

    I bought my car in Florida. I moved to California a year ago and paid my car off while living in CA. The CA DMV shows I still have a lien. The Florida DMV has an electronic version of the title. Can the FL DMV fax the electronic title to the CA DMV? How can I show that I no longer have a lien in CA where my car is registered? Thanks.

      The DMV requires a clean original FL title ( No Liens) to generate a CA title. The CA DMV will not accept a fax or copy of a title. The FL DMV will need to print a new title for you. Etags offers a duplicate title service within Fl you can use for your request at

If ownership was never transferred between you and the previous owner the application will have to be completed with the previous owner’s information.     FL tag was originally in my name. Later on, bought(leased) a car with my ex husband, him being the primary, tag was put in this car and got changed to his birthday as the expiration date.
    I’ve refinanced so the car would only be in my name. But tag is still with his birthday as expiration date. What is the process to change it to mine and remove his?

      Removing an owner from the title and registration will require a notarized letter from the lienholder granting you permission to remove your ex-husband’s name. You must take the notarized letter to your local tag agency to update the name on your vehicle’s registration.

      The dealership is correct. There is no need for action at this time.       In cases as such, you must contact the Leasing Company and request removal of decease individual’s name from the lease agreement. When dealing with the registration, the leasing company normally provides the customer with a Power of Attorney, and a revised lease agreement or lease assumption letter. In terms of processing, the correction is made only on the registration.

    I am moving from California to Florida at the end of the month. I bought a new car about eight months ago and still owe money on the vehicle. I want to register it in Florida but they’re asking for a Lienholder transfer. Is there an easy way to do this? Is this something that can be done through your business.

      Because your vehicle has an out-of-state title and lien, you must complete a Title Release Form, https://www.flhsmv.gov/pdf/forms/83060.pdf
      then fax it over to the lienholder. This form will permit the lienholder to mail the original title directly to the agency.       Yes, you will want to take your existing plate and registration to the dealership who will transfer the registration and plate to the newly purchased vehicle. Transferring a tag will save you a $225.00 in new plate fees with the dealership.

    I am a florida resident. My brother in Massachusetts gave me his old car. He signed the title over and mailed it to me. I would like to transfer plates from my current car over to this out of state car, then, take a rental up to Massachusetts and drive it back to Florida. Is this possible? How do I do this? Can it be done online? Do I need anything besides the title, my current registration, drivers license and proof of insurance?

      I was trying to sell a car but found out it has a lien, i paid it off 2 years ago so i went to the used car dealer And they went out of business. And theres no available appointments for the dmv. Is there any other way to clear the lien so i can sell the car? Or at least get into the dmv

    I’ve seen similar comments here but my question is slightly different: I want to buy a boat from a private seller who has received the boat as a gift. The original owner signed the Title to transfer it but didn’t put any other information on the Title except her name and license number. Can the current owner write “gift” on the Title and apply for a Title transfer and how does that work in Florida? Are there special fees to pay? Does he have to pay sales tax or a gift tax?     I am a resident of Florida and a friend in South Carolina is gifting me a car. Since the car is being gifted by a friend and not a relative will this create any issues when trying to title the car in Florida? When they fill out the back of the title for sale price would they put “Gift” or $0.00. They are also creating a Bill of Sale. Should they put the sale as zero dollars and indicate that it is a gift as well? We just want to make sure everything is filled out properly. Thank you.

    Dear guys, thank you for your help!
    Here my problem: I live in Florida where I’m resident but I’m gonna spend a couple of months in NYC for work.
    I just bought a motor-scooter in NYC from a friend (very cheap, I thought “at least in this small time I’m not gonna get the subway with a pandemic still around, then I might bring it back to FL”) and I got the Certificate of Title issued by the New York State.
    I later found out (in disbelief) that you can register and get a license plate only in the State you are resident. I’d ask “why the hell??” but I can understand there must be a reason for that.
    Which are my chance to use it now here in NYC, transferring the ownership and getting the license place?
    – Can I register the scooter at the Florida DMV – Transferring the Out of State Title? Then ask for a license plate here and using it?
    – If yes, will it cost really $495? I paid the scooter $150…
    – Can you guys do everything? How much is your fee?
    I thought that US bureaucracy was smarter than the Italian one: silly me! If I don’t have a solution I have to return it and enjoy the subway… crazy rules!

      The DMV should have provided you with a lien release form to send to your lender. The lender would send the title directly to the DMV office that would process the new registration. We recommended calling that DMV office or a different one to get the required form since each county uses a different lien release form. Best of luck.

    I have a few questions. I moved to FL from TX 10 months ago. I barely got my FL license since the DMV has been closed due to the virus. I work remotely and work for agents in different states (including FL) and my car is a lease.
    1. Since I just got my license, do I NEED to change my title to FL? I live with my sister so I don’t own or rent a property in FL to have the standard 30 days to change everything to FL. Not sure if those 30 days also apply once I get a FL license.
    2. If I don’t need to change the title of the car yet, could I wait until the tag expires in November?
    3. If I do need to change it, how much total would I need to pay? I am trying to avoid costs as much as possible. I read in a previous comment someone having a similar situation but they only paid around $75 and still got the plates? What would be the best way for me to spend as little as possible? Unless I don’t have a choice and spend the $495

      Welcome to Florida. Because It’s the Law in Florida, you must change your address within 30 days of moving. If you fail to do so, you risk getting a traffic ticket with a hefty fine. If you have never had plates in the state of Florida. Yes, you will have to spend about an estimate of $495.

    I just purchased a vehicle on line from a seller that lives in Knoxville Tennessee. I paid him with a cashiers check and he provided me with the title to the car. I made arrangements to have the car delivered to my residence. I also requested that he send me a bill of sale so I could transfer the title. He said okay but when I received the title in the mail, there was no bill of sale. I called him but he refuses to provide me with a bill of sale. His name is not on the title because he purchased the car at an auction in Kentucky and apparently he doesn’t want to pay the sales tax on it. This leaves me with the inability to put the title in my name. Is there anything that I can do? I thought he was a dealer since he has several vehicles listed on Facebook Marketplace inside a building with a showroom. He tells me the title is an open title which is why his name does not appear. I know the vehicle is not stolen as I asked a law enforcement officer to run it and it came back registered to the person on the title which is not him.

      You’re going to have to contact an attorney…. the attorney will have to litigate and prove that you now own the vehicle in the absence of a properly signed title or bill of sale

      In order to register a car in Florida, the title must also be transferred to FL. Most likely, the title was released from the lien holder to the FL DMV electronically, and it is being held until the car is paid off, otherwise, you would not have been able to get Florida registration and plate.     I just went on the FLMV site to update my address. To my surprise, it is showing a vehicle I traded in to a large dealership in South Florida back in 2007! More concerning is that I don’t believe I ever saw this vehicle still on my record in previous years when I would update electronically through your website. This car never had a title in Calif, as Tilles were never issued in Calif at that time and was only registered when it was Shipped to Florida..       You (the parent) would need to complete Section 1 and Section 2 on Form 82139 to be included on the title as a lienholder. That form along with the original title, your daughter’s driver license and a proof of Florida insurance is required to transfer the title in your daughter’s name and add the parent as a lienholder.     I recently moved from California and processed the initial request of FL title and Tax collector office requested title of my car from lienholder, unfortunately a day before i receive the letter from tax collector office which saying they have my title and ready for transfer all the tax collector offices are closed due to COVID-19 and now i received another letter from Tax collector office saying if i dont show up in tax collector office they are going to return the title to California. I visited most of their offices all are closed and the one is open is fully booked and they are not answering my calls. Please someone help me.

      Sorry to hear that you are experiencing this. Unfortunately, since that Tax Collector’s office is in possession of the title, only that office can assist with this. You might try sending an email if you can find a contact email on their website or mailing a priority letter. Keep in mind that, if you were issued a registration pending receipt of the title from the lienholder, you have until that registration expires to complete the title transfer. Should the Tax Collector’s office send the title back to the lienholder, you can start the process again whenever you are able to get an appointment or assistance by phone/email. Best of luck.

        Motorcycles must have titles in Florida, Only mopeds and motorized bicycles are not required to have titles. Unless you confirm that the NY DMV will accept a bill of sale once you go to register it there, we highly recommend that you get the signed Florida title from the seller.       Although tag are not transferrable in FL, there are others way to avoid that impact fee. (1) if the owner of the vehicle and the receiver of the vehicle have the same address on the driver’s license and state system, they qualify for $225.00 initial fee exemption. (2) Add daughter’s name as primary owner. In other words, it will remain in both the owner (you) and daughter’s name but daughter’s name will be primary.

          The lien satisfaction letter alone will not work in Florida. You must have either the title in hand (signed over to you by the seller) or a notarized Bill of Sale. Only the current titled owner can request the title to be printed or, if he goes with you to the Florida tag office, he can complete the transfer to you in person at a DMV office.

    Hi! I just moved to FL and I need to renew or transfer my Tag registration from GA. The problem I have encountered at the office is the need of my physical Title from GA. I have checked the records on GA DMV and my Title evidently was ASSIGNED/ Never issued for a mailing inaccuracy. GA currently does not have a system to transfer Titles to local states.       This is a matter of the Lien holder, you’d have to contact your lienholder and provide those documents. The lien holder will either process the name change OR send the paperwork out to an agency for processing.

    I stopped renewing the registration in 2009. In 2019 I stopped by the DMV office to get new plates. A girl at the counter told me I had to pay the impact fee of $225 in addition to the registration fee. I showed her the plates with 2010 decal, my registration for 2010, and a copy of my original title dated 1985. She still insisted I needed to pay the impact fee. The late fee of $10 or so is reasonable, but paying the impact fee, again, is not a requirement, as I understand. Am I right?

      Typically the $225 fee is for a new registration, not sure why they mean by ‘impact fee’, Perhaps try calling the dmv and compare the answers with what you were told fist.

      In Florida the registration has to follow the title. In fact, even the order of the name will stand so whichever brother is listed first on title will be listed first on Registration. (And it is his birthday which will determine the expiration – unless it is a truck. (All trucks expire 12/31 in Florida.)

      Assuming that the new vehicle is already titled in your name, then you would need to submit an order to Transfer Plate on etags.com. If the vehicle is not titled in your name, then you would need to submit an order to Transfer Title/Registration. Since you already own a Florida license plate, you will not pay the $225 initial reg fee.

If the address on your license is the same as the address currently on the registration, you can transfer that registration and plate into your name without paying the $225 new plate fee.           to complete the VIN Verification. However, since you’re out-of-state, an Ohio Police Office can only complete that form.
          Alternatively, you can have the VIN Verification completed by/at your local Ohio Bureau of Motor Vehicle (BMV) or an Ohio licensed dealership, but it must be completed on their business letterhead.

      On the front of the title, your cousin would need to print and sign his name as a Seller, then you would print and sign your name as a Purchaser.

          If in the title the names are joined by an “or” your girlfriend can register the vehicle in her name only. If the Names are joined bu an “and” the vehicle must be registered in both names .

      We’re assuming you have a lien on the vehicle. You don’t have to be present as long as you sign an Application for title form which eTags provides. The reason why it expires on your B-day is because your name was placed first on the title, but it’s not an issue. etags will need title, Proof on isurance and both driver’s licenses.

          My boyfriend’s boss bought him a van. His boss takes money out of his check to pay for the van. When he bought the van he did not have liscence.we put the van in my name. Since then he now has liscence. He left me. I signed the van title and sent it to his sisters. I notified her I was keeping the insurance on long enough for him to put everything in his name. I also asked he turn my tag in. No I find out my liscence is suspended. He wanted to get back together. I never dated the title given him time to put in his name without penalty. He still hadn’t signed title. I say still his van almost paid. What can I do. Have no money or transportation . Does this increase insurance when I get another vehicle?are there points too?

    My daughter leased a car in NY & moved to Florida. She got herself a FL license and had the car re registered, a new Fl plate & insurance. While at the DMV they took her title and said it would be now be considered an electronic title in FL even though it was still a leased vehicle. After one year she moved to NC did the same thing, got a new license, new registration, plates and Insurance in NC. She has now just moved back to Florida and has not yet re registered her car as her lease is now up and she turning in her lease here in FL and buying a used car at a dealer. She has not yet returned her NC plates. The dealer is charging her $523 in Tag and Title fees. Since she already had the title to the car electronically recorded here in FL when she 1st moved from NY to FL shouldn’t that title still be on file here in FL? and wouldn’t that cut the cost the dealer should charge? What fees would she be required to pay in this situation? I think they are trying to rip her off.

There’s no hassle if a selling price is declared, the process is still the same, but it’s better to do it as a gift because you are exempted from taxes.       As far as the title, the owner of motorcycle will have to sign as seller and provide a bill of sale with full description of the vehicle. We recommend you leave the buyer portion null so your son can fill it out while the buyer is present.

As in would I pay New York or Florida tax, whether or not it would be a new to Florida registration if the carfax showed it was in Florida in the past?

      In FL, there’s a 7% tax, so you’d pay the difference if you already paid in NY. It’s considered a new registration even if it was in FL before, unless you have a valid FL plate you want to transfer.

      Your ex spouse would have to sign as a seller, and you would have to sign as a buyer in order to get the title transferred.
      If you were awarded the vehicle thru a divorce settlement, then you would only have to have that proof when you title the vehicle.

    I am a NC resident who has a son who had a car titled in Florida in his name. He has moved out of Florida, no longer needs the car, and wants to transfer the vehicle to me, title to be in my name in NC. I have his original title. Can we just fill out the bottom front of the form, top of the back side, and take it to NC title agency? There is a line for “selling dealer’s license Number” but this is a private transfer between relatives for $0.00 (aka, Gift), so what should be put in that area, or just leave blank?. I can follow the NC instructions for obtaining a title, but didnt know if anything needs done from the florida side other than him signing it over. Please email reply, Thanks.

    Hello, we are a Virginia corporation with a Florida-registered car for one of our sales people. I need to request a duplicate title and have the 82101 form all filled out, but when I called the DMV this morning, they said I need to include a letter from an authorized corporate individual (in this case our CFO) on his letterhead specifically requesting this info and stating he has authority to do this. When I asked for a sample letter or language I was told there isn’t any. Can you please tell me what, exactly, this letter needs to contain and if there is a sample I would appreciate it.

      If your motorcycle is leased then it’s still owned by the dealership. Before selling it you would have to pay it off to claim ownership and then sell in FL.

    Hello, I just moved from California to Florida and want to register my vehicle, but California is an electronic title state, as is Florida, but when I went to the local Tag agency in Florida they said I needed a physical copy of the title. I’ve sent paperwork to California to obtain a physical copy of the title (I’ve owned the car paid off for 7 years) but it’s only available to do by mail and it’s been over a month since I sent in the paperwork with no reply. Is there anything else I can do? Do I need to go to the downtown courthouse to use the electronic title? It’s frustrating since the DMV here will not have anything to do with vehicles.

        What if the seller is not replying to calls or texts? They didn’t sign the title in our situation either but did sign the bill of sale. However, once they received cash from us for the car, they drove off and then the car wouldn’t start. We had just driven it and started it with him there and everything was fine. Now we had to tow it to a mechanic and are expecting a huge bill. We feel he took our money for a crap car and knows it so won’t reply to us. What should we do? We don’t want the car anymore. Had to leave it in a different city 4 hours away until fixed. With the seller handing us the title without signing it though, didn’t he kind of dig his own grave here? Isn’t he still legally the owner? Should I talk to a lawyer or police or someone else? I don’t know where to go or what to do honestly. I realize the money is probably gone for good but just really don’t want the car anymore and don’t think it’s ours anyways right now but still belongs to the seller. Any advice you have is greatly appreciated!

      Hello Roman. Upon transaction, you will need to hand the Bill of Sale to the buyer. As for your license plate, you are allowed to mail it to the address specified on the registration renewal notice or website. If you are selling the car to another party, you won’t need to pay any fees, but you will need to ask the DMV in your new location for further information. Good luck!

      Hello Christie. When you are transferring a vehicle to another person from out of state, the DMV usually asks for the Vehicle Identification Number (VIN) to be specific about the vehicle you are trying to transfer.

      If you have already titled the vehicle in your name, then you’ll need to sign over the title to your relative. Your relative will have to title vehicle at the nearest tax collector’s agency.

      Make sure you fill out the sellers section and sign on the right section. Report the transaction to the DMV to no longer be liable for the vehicle that is no longer in your possession after the transaction. Good luck.

      Hello John. If you want to register and title a vehicle, you’ll need to demonstrate that you are the legal owner of the vehicle. In FL, it is illegal to drive a vehicle without tags.     I would greatly appreciate some advice. I am in Florida and recently purchased a car from a dealership and we negotiated a price for my trade-in. However, I inadvertently took my original title (on the trade-in) home with me and am in the process of sending it back to the dealership. I’m confused because I was informed by the salesman that I DO NOT need to sign the original title in order to transfer ownership. However, when I read the bottom of the title, it states that the law requires that the Seller sign and fill in the details of the mileage and price.

You could do that by requesting a temporary tag with the DMV in NY and drive the vehicle down to FL for a new registration.       Hello Tim. Typically, you must submit:

      A FL title application form.
      A certified copy of the will.
      An affidavit stating that the estate is solvent.
      Original title certificate.

      You will need to follow those steps one vehicle at a time.

      Florida also requires a separate form that highlights the vehicle identification number and the odometer reading, proof of valid auto insurance and any loan agreement still pending on the vehicles.

      If the deceased owner never wrote a will, you may need to submit an Affidavit stating that the estate is not indebted and survivors have agreed on the new owner. You are also advised to contact your local DMV agency for more information about the status of those vehicles and receive further guidance.

      – You establish residency through rental, lease, or purchase of an apartment or house.
      – Start working in the state.
      – Register your children for a Florida school.

      – Buy a valid FL auto insurance.
      – Have a VIN inspection and odometer reading completed.

    Hello, my mother is looking into renewing tags of 2 vehicles that her and my father own jointly. He passed away 2 years ago but we still renew the tags on his birthday since he was listed first on all of the forms at purchase of the vehicles. She is hoping to go in and have his name taken off of the tags of both vehicles this May. What paperwork does she need to bring in person for this to the FL DMV? We have read that she may need affidavit’s from his estate which we have yet to get in order since she was the joint owner of every asset he owned. We greatly appreciate your help!

      Hello Tess. It depends on the nature of the joint ownership. If the title shows a joint ownership with an “OR” value, your mother would just have to request a new title with the DMV. If the title shows that your mother “AND” your father are the legal owners of the vehicle, your mother will have to request a new title and submit an affidavit sustaining that the other owner has passed away and the vehicle hasn’t been given to any heir.

    I just moved to Florida with a vehicle LEASED in NY, and I need to register it in Florida. Since it is a lease, I do not have the physical title. I am told that I need to get a specific request form from the DMV which is then mailed to the leasing company, after which they send the title directly to the DMV. Once received, the DMV then contacts me, after which I then return to the DMV for the actual transfer of registration. Seems to be a convoluted process. Is this correct? If so, can I get the request form somewhere online (I can’t find it at the DMV website) so I don’t have to stand on line at the DMV twice? Can you walk me through this registration process for an out of state leased vehicle?

      Hello Chad. Once you refinance your vehicle, the second lender covers the loan set by the first lender which makes the second lender (USAA) the new lien on your vehicle. A different lien does not mean that you need to make any changes on your title. You should contact your local USAA agent to learn more about the specifications written on the agreement in regards to your vehicle.

      Hello D. The state of FL requires residents to present the out-of-state title in order to process the registration. There are also other requirements which you must consider prior to registering your car such as:

      – Get a FL driver’s license.
      – Have a valid FL auto insurance.
      – Have a VIN inspection and odometer reading completed.

      Once you complete those requirements, arrange an in-person visit to the DMV take the following steps:

      – Show your Florida driver’s license.
      – Submit proof of Florida insurance.
      – Present the title if you own an out-of-state vehicle.
      – Have your vehicle identification number (VIN) verified on the Vehicle Identification Number and Odometer Verification form (Form HSMV 82042).
      – Submit a completed Application for Certificate of Title With/Without Registration (Form HSMV 82040).
      – You are also allowed to register the vehicle for either 1 year or 2 years.
      – Submit the completed Vehicle Identification Number and Odometer Verification (Form HSMV 82042).
      – Then pay all registration and tax fees.

      As you can see, you won’t be able to register your car without showing the title as a proof of ownership.

      In Florida, the name of the individuals who are included on the title must be listed on the registration as well. You cannot register to one person while having two people on the title. And you cannot have someone on the registration whose name is not registered on the title.

    I have purchased a 23′ power boat from Louisiana (five days ago) and trailed it back to Florida (my home state). I have a copy of the notarized Bill of Sale from the seller, Letter of Acceptance. I worked through a brokerage firm (POP Yachts) and am awaiting titling paperwork for transfer of registration to Florida, etc. Question: is there a period in which I can operate and/or trail the boat legally, awaiting this paperwork?         That was the first place I went… they deferred me to the Florida Fish and Wildlife. Reading the state code, it is a little unclear on a 90 day period of operation allowed if the vessel has a “current and valid registration” from another state (which the vessel does). I should receive the title today (hopefully before the tax collector’s office closes!). If not, was hoping to boat this weekend. Thoughts?

          Hi Chris, we were able to research this further and found that statue 328.46 for Operation of registered vessels indicates that, within 30 days from the date of sale, the completed bill of sale can serve as a temporary certificate allowing operation of the vessel. While we recommend calling the tax collector in your county or legal counsel to confirm if you should have any other documentation or take any other precautions, current state law provides this grace period.       Hello Jillian. In Florida, gifting a vehicle is treated as a selling procedure.

      1. Here is a list of items that you need to submit when titling a vehicle.
      The completed original title with sale price, buyer’s name and address, seller’s name and address.
      Completed Application for Title.
      Completed Notice of Sale.
      Odometer reading verified.
      Your driver’s license.
      Proof of insurance.
      Approved loan documentation.
      The vehicle that is being sold.
      Payment for all fees and taxes due.

      Of course, your father is gifting you a vehicle which exempts you from paying taxes. However make sure to fill out the title with a zero sale price. You will have to provide an affidavit that you are receiving the vehicle from a relative.

      2. Gifting is treated like a selling procedure so make sure you submit the required items.

      3. As long as your father signs the required sections you can schedule an in-person visit without his presence. Good luck.

    My uncle gifted me a car back in Sept 2018. I never transferred the title cause I didn’t need the car at the time and didn’t want to pay for insurance on a car to sit there. I have a niece that needs a car so that she can go back to work and i would like to give her the car. Can a double transfer be done or do I have to register the vehicle in my name and then sign the title over to her for her to do the same thing? We are trying to keep it as cheap as possible cause neither of us really has that much extra money.

      Typically, if you inherited a vehicle in GA, you will need to provide the Motor Vehicle Title/Tag application, the original title with the name of the deceased person on it, A Notice of Satisfaction of Security Interest or Lien Holder’s Affidavit (Form T-4) if applicable, a document that states you inherited the vehicle, and the title transfer fees. Though there may be other requirements along with this procedure since the vehicle comes from another state. Please contact your local DMV for more information about titling vehicles from deceased owners.

    Hello, I have quite the question for you: I bought a car in California (active military, stationed there at the time). The car is registered in California. I just recently paid off the loan, and have not yet received any confirmation of release of lien. California and florida are both e-title states. How do I register the car in Florida as I am a FL resident active duty military member stationed out of state? I do not have a copy of the title as CA is an e-title state. I am also now stationed in a third state, so I will be transferring the registration to FL all remotely by mail. I have the FL military registration packet, but I’m not sure how to provide proof of ownership in my situation. How do I register the car in FL if I do not have a phsyical copy of my CA title? How do I receive proof of ownership in an E-title state once I pay off my loan? Thank you very much!

Since you are a Florida resident stationed in California for military duties, you are allowed to register your vehicle without having to arrange any in-person visit with the FL DMV. You will need to fill out all the following forms and send them along with payment for registration fees to the county tax collector’s office in your county of residence:

      Members of the military who are Florida residents but are stationed in another state can still register their vehicle in Florida. Fill out all of the following forms, and send them along with payment for registration fees (see below) to the county tax collector’s office in your county of residence:

        The original vehicle title, or an Application for Certification for Title With/Without Registration (Form HSMV 82040) if you also need to title your car in FL.
        Florida Insurance Affidavit (Form HSMV 83330).
        Military Insurance Exemption Information.
        Military Initial Registration Fee Exemption Affidavit (Form HSMV 82002)
        Exemption from Florida Sales Tax for U.S. military service members.

      While you don’t need to submit your title to register your vehicle, you will need to have a proof of your previous registration to complete this procedure as indicated. In addition, you can file a Power of Attorney for a Motor Vehicle, Mobile Home or Vessel (Form HSMV 82053) in order to allow a third party to file your Florida vehicle registration paperwork for you. As you are registering your car in the state of Florida for the first time, you will need to visit the nearest DMV office, and bring your title (Important requirement), proof of ID, and a valid FL insurance card. You will also need to submit a completed Application for Certificate of Title With/Without Registration (Form HSMV 82040), VIN inspection, and Odometer Reading along with the $225 initial registration fees, title fees, plate fees, and taxes.       Hello Linda. Once you get the title which usually takes between 4 to 6 weeks, you’ll need to re-title it as you probably know. Now, whether you need to sell your van in Florida or New Jersey, it’s completely up to you. It possibly makes more sense to title wherever you are located to avoid complications.

    I am moving to Florida from California and have a couple questions. I have a DMV appointment for when I arrive. I’m bringing my marriage certificate (got married, new name), new SSC, proof of insurance from Florida for the vehicle, my proof of residency, and my vehicle title (which has my mom and I on it, she will be with me). I will be transferring title from both her and I to just me. Also, for the VIN verification, can I do the form a week or two beforehand by a law enforcement officer in California? And when I fill out that form I just submit it to the DMV during my appointment with everything else? I just don’t want to miss anything at DMV, so I can get it all taken care of at once. Thank you.

      Hello Mandi. You can get your VIN inspection with a law enforcement officer in California and that would work just fine once you get to your appointment in FL. Now, if you have the form with you, then you can wait until the day of your appointment to have an agent inspect your VIN and fill out the form at the DMV in Florida. Both scenarios are valid so keep that in mind.

    I have a motorcycle that is titled and registered in FL. I will likely be selling it to someone in the state of Florida. Problem is that I’m not the actual owner, I’m the executor on a will for the owner. In FL they won’t let me sell her house even though I’m the executor, her closest relative needs to do it. I wonder if I can sign the title over in Florida for the vehicle, or if I have to have her sister do it instead like we have to do with the house.

    When I moved to Florida (from NC) almost 3 years ago, I registered my car. At the time, the DMV said I could leave the vehicle titled in NC. Sounded strange, but they are the experts.

    I recently paid off the car and got the notification of lien release. I would like to get a paper title and have it titled here in FL. I’m assuming that NC will send the title to me, but I’m not sure if they have my address (unless it was updated by FL DMV when I registered the car here). Do you know how I can get the paper title from NC now that the car is paid off?

      Hello Maynard. Since you’ve registered your car in Florida, all you need to do is contact the DMV in NC to request a title replacement in case you don’t have it with you. You don’t need to re-titled your car as it applies to any state you move. However, you need to make sure the NC DMV has information of your current address on their records, otherwise you’ll need to update your address to avoid losing your title on the mail. We had planned to drive his down, then sell it, wondering if it would be simpler and less costly to sell car in Ohio and get a rental I can just drive for the move down.       Hello Laura. Your car has to be registered but you don’t need to register it in Florida to sell it in Florida. Now, you don’t need a driver’s license to a sell a vehicle as long as he is not driving it. But you need to make sure you have your clean title during the transaction.

Note that there’s a $2.50 service fee for printing an mailing. Alternatively, you could visit your local Tax Collector branch. Many of those branches could provide you the paper title during your visit for a $10 expedited service fee.

Florida requires car owners to hand over the title to the person they are selling or gifting the vehicle to.     Please help! My fiance died almost a year ago. His name Only is on the title of the car we both drove. I have continued to drive it all year and was able to get new insurance in my name. They didn’t care that my name is not on the registration. It is almost time to renew the registration. Can I renew it online in his name? Or do I need to transfer the title to my name? And how do I do that? There is no probate, he didn’t have any beneficiary named, and no will. His parents are deceased, but he has a sister and 2 brothers. I only know the sister, and she is very cooperative and willing to help me with the car. She does not want the car. Please help.. Thank you.. – Sue

    I helped my son-in-law buy a car, so the title lists both of us as owners (OR). Now he has paid off the vehicle, and I want to remove my name from the title. The title is electronic. Not sure how to proceed.

    Hi, I have bought a car from Oregon. I have the title and car. It is not clear if there is a difference between the $225 new car to Fla fee and/or the new vehicle registration fee of $225 for a new plate, are these separate charges or are they to be added together for a total of $450.

    My uncle wants to gift me his car that is registered in Florida. He can’t find the title but I have full power of attorney for him.. Would I be able to go to a local DMV office and sign his name if I bring my POA paperwork? Also, since I live in NY and plan to drive the car back home, I guess I would need to contact the NY DMV to get plates mailed down to me?

      Hey Mike. You will likely first need to submit From HSMV 82101 application for duplicate. The title will need to be presented in order to prove ownership when attempting to complete transfer of the vehicle.

      Once the title has been replaced you can easily receive the vehicle as a gift in the state of Florida. Just like when you buy or sell a car, you will need to complete the vehicle title transfer documents. More info on that can be found on the FLHSDMV website. Once transfer has been completed, be sure to complete one of the following to prove the gift has been received: 1) Bill of Sale OR 2) Affidavit

    My husband just traded some power tools and equipment for a pontoon boat. We received the title but need to get it registered. How does the previous owner fill out the title transfer and trailer registration where it says amount paid? Since it was a trade and we did not purchase the vessel, there isn’t an amount to fill in. Would the previous owner write “trade” in that spot?

      Hey Gabrielle. You would write the estimated value of the equipment and tools your husband traded for the boat on the vessel title transfer form where it says “amount paid.” It would also be a good idea to gather any receipts and documents that validate the value of the tools, as this may be a somewhat arbitrary figure.

    OK so my brother is the cosigner on my car, he lives out of state, we just moved here. What forms do I need to have the title transferred down here? It’s all very confusing to me. On form 82040 does my brother fill out as owner or co owner? My name is on the registration and insurance. Also, like I said he is not a Florida resident and they ask for a FL DL #, so should I just have his out of state license number for that? Thank you in advance.

    Hi everyone, if you are moving from one state to Florida, the simplest way is to give the local tax collector’s office a call. They will provide you with all the information you need.
    This is what I’m bringing to the tax collector’s office in order to get my Florida Title, Registration, Tags, and Driver’s License:

    Blank Forms: 82040 and 82042 (VIN and Odometer Verification and Title Application).
    Proof of FL Insurance (You’ll need to get that before you go into the office).
    My previous state’s Certificate of Title (I’ll have my Lienholder info as well).
    My previous state’s Driver’s License.

    Bring your credit card too… it’s pretty costly.

      And in addition: To get the Florida DL (if you have a license from another state), you will need 2 forms of proof of Florida residency, SS card, and original DL. Call them for more info if you aren’t a U.S. citizen.

            Hello Mandi. You can get your VIN inspection with a law enforcement officer in California and that would work just fine once you get to your appointment in FL. Now, if you have the form with you, then you can wait until the day of your appointment to have an agent inspect your VIN and fill out the form at the DMV in Florida. Both scenarios are valid so keep that in mind.

    Hello, last time i purchased a car from a person was back in year 2000, i call the insurance, print the insurance policy them took it to dmv with singed tittle, no bill of sale, and paid like 250 bucks for registration and plate, years later got a new car from a dealership they did all the paperwork i just drove out with a paper plate !! until plate came in the mail, now i’m about to get a car from an individual , used car, it seems like the steps to register and get your plates has become a little complicated since year 2000 ?? no lien , not lease . What and how much do you think i may need ?
    value of car 2000, year 2007 sedan 70k miles.

      The webstite for the department of motor vehicles is www.flhsmv.gov and it may be down temporarily on some occasions but is usually up and working. You can find the detailed steps of transferring the title on this blog post in the section “Buying or Selling a Vehicle” and by focusing on the right-most column titled “Selling a Vehicle”. You can print both forms, 83330 and 82040, from these pages: http://flhsmv.gov/dmv/forms/BTR/82040.pdf and http://www.flhsmv.gov/dmv/forms/BTR/83330.pdf In regards to your plate, you can either transfer that to another vehicle you own or turn it in at your local tax collector’s office to have the plate cancelled.
