FL Transfer in lieu of family death for vehicle with lien
Florida Title & Registration
My mom passed away last year without a will. She bought a Fl vehicle that has a lien on it which my grandmother co-signed. Both of them have since passed away so the car is just sitting there but I am unofficially paying the monthly payments. My question is “Is it possible for me to go to the DMV and explain the situation, register the car in my name until the probate process is complete next year in which I can have the car loan in my name?” Is it possible to register a car that isn’t mine that has an active lien on it but the person is deceased? The car is also insured under me as well.

Hi, our condolences on the passing of your mom and grandmother.
Without an official letter from the lien holder, the Florida DMV will not transfer the title and registration to your name. You will need to contact the lien holder and usually a lien holder would process a credit application in your name to transfer the loan to you. They would then process the title and registration transfer directly with the DMV. The lien holder may have specific procedures and exceptions for transferring the loan/lien, title, and registration in this case. Ultimately, you should contact the lien holder first and/or seek legal on how you should proceed while you wait on the probate process to be completed. Best of luck.
