Simply put, probate is the legal process an estate goes through after a person passes. There may or may not be a will and\/or living trust with probate procedures.<\/p>\r\n\r\n\r\n\r\n<p>If there is a will, the process can prove to be easier since the deceased person\u2019s wishes have been recorded on paper. All there is for the court to do is authenticate\/validate the will and authorize the beneficiary\/executor to pay any outstanding bills and taxes and execute the plan\/will.<\/p>\r\n\r\n\r\n\r\n\r\n\r\n<p><strong><span class=\"has-inline-color has-vivid-green-cyan-color\">Vehicle Transfer Without Probate and Form REG 5<\/span><\/strong><br \/>Transferring cars, motorcycles, and boats after death without probate, means you&#8217;re inheriting a vehicle and can keep it or sell it. The California DMV just asks that you fill out Form REG 5 also called <a href=\"https:\/\/www.dmv.ca.gov\/portal\/file\/affidavit-for-transfer-without-probate-california-titled-vehicle-or-vessels-only-reg-5-2-pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">Affidavit For Transfer Without Probate California Titled Vehicle or Vessels Only<\/a>. REG 5 has you sign and certify that there\u2019s no probate proceedings.<\/p>\r\n\r\n\r\n\r\n<p>BUT, you can only transfer the car 40 days AFTER the decedent\u2019s death. Also, the total property of the individual who has passed away can\u2019t exceed $166,250 If you\u2019re next of kin, conservator, beneficiary or trustee, you can submit the request for title transfer without any letters of administration or testamentary (issued by a court\/public official authorizing the executor of a will to take control of a deceased person&#8217;s estate).<\/p>\r\n<p>Please note: A power of attorney or POA can\u2019t be used to complete REG 5<\/p>\r\n<p><br \/><strong><a href=\"https:\/\/www.etags.com\/blog\/most-common-forms-needed-for-selling-your-vehicle-privately-in-california\/\" target=\"_blank\" rel=\"noreferrer noopener\">SEE ALSO: MOST COMMON FORMS FOR SELLING VEHICLE PRIVATELY<\/a> <a href=\"https:\/\/www.etags.com\/blog\/most-common-forms-needed-for-selling-your-vehicle-privately-in-california\/\" target=\"_blank\" rel=\"noreferrer noopener\">IN CALIFORNIA<\/a><\/strong><\/p>\r\n\r\n\r\n\r\n\r\n\r\n<p><strong>You\u2019ll need a few details to complete REG 5:<\/strong><br \/>\u2022 VIN number<br \/>\u2022 Make and model<br \/>\u2022 License plate number<br \/>\u2022 if it\u2019s a motorcycle you\u2019re inheriting, then you need the engine number<br \/>\u2022 Date and place of decedent\u2019s death<br \/>\u2022 An original or certified copy of the death certificate for\u00a0all\u00a0deceased registered owners<br \/>\u2022 The title transfer fee; if you\u2019re selling to someone, you\u2019ll have two fees to pay<\/p>\r\n\r\n\r\n\r\n<p>The title of vehicle to be transferred in this manner must be a California title not out of state. You must sign the CA title on the registered owner\u2019s name\u00a0and\u00a0countersignature on line 1.<\/p>\r\n\r\n\r\n\r\n<p class=\"is-style-cnvs-paragraph-callout\">If a CA vehicle is owned by two or more deceased owners, the Affidavit For Transfer Without Probate form applies for the most recently deceased owner only<\/p>\r\n\r\n\r\n\r\n\r\n\r\n<p><strong><span class=\"has-inline-color has-vivid-green-cyan-color\">Vehicle Transfer With Probate<\/span><br \/><\/strong>Typically, a full probate process in California takes a little over six months, so it\u2019s best to start ASAP. When court proceedings are involved in the <a href=\"https:\/\/www.etags.com\/app\/us?utm_source=blog_article\" target=\"_blank\" rel=\"noreferrer noopener\">transfer of the vehicle<\/a>, the administrator or executor signs the CA title by signing the decedent\u2019s name and writing: \u201cby (name of executor) Executor.\u201d<br \/><br \/><strong>You\u2019ll need:<\/strong><br \/>\u2022 Letters testamentary or court order that authorizes you to make the car transfer<br \/>\u2022 An odometer disclosure if the car\u2019s less than a decade old<br \/>\u2022 Title transfer and\/or California registration fees<br \/>\u2022 <a href=\"https:\/\/www.dmv.ca.gov\/portal\/file\/statement-of-facts-reg-256-pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">Statement of Facts Form REG 256<\/a> for tax exemption and smog exemption<\/p>\r\n\r\n\r\n\r\n\r\n\r\n<p class=\"is-style-cnvs-paragraph-callout\">It&#8217;s good to know that any inherited vehicle won\u2019t require a smog check if the last smog certification was obtained within the last 90 days.\u00a0\u00a0<\/p>\r\n\r\n\r\n\r\n<p>And that wraps it up title transfers upon inheritance in the Golden State.<\/p>\r\n<p>Remember, if you happen to inherit your next set of wheels, you can transfer ownership online with us at <a href=\"http:\/\/etags.com\" target=\"_blank\" rel=\"noopener\">etags.com<\/a> quickly and easily.
