While it may be impossible (for now) to prevent all drunk drivers from getting behind the wheel, technologies like Ignition Interlock Devices, can at least keep repeat offenders at bay.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An Ignition Interlock Device (IID) is one that is wired into the vehicle\u2019s ignition system. In order to start the vehicle, the driver must blow into a tube connected to the side of the ignition. If the driver is intoxicated, the vehicle won\u2019t start. It\u2019s a tool that\u2019s used in all 50 states with the purpose of keeping individuals who have had prior DUI convictions from drinking and then driving. However, laws differ from state to state.<\/span><\/p>\n<p><!--more--><\/p>\n<h2><span style=\"font-weight: 400;\">Required Use of IIDs<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">There 18 states that require the use of IIDs on <\/span><span style=\"font-weight: 400;\">all<\/span><span style=\"font-weight: 400;\"> offenses (1<\/span><span style=\"font-weight: 400;\">st<\/span><span style=\"font-weight: 400;\">, 2<\/span><span style=\"font-weight: 400;\">nd<\/span><span style=\"font-weight: 400;\">, etc) with BACs of .08 or higher. Those states are:<\/span><\/p>\n<table>\n<tbody>\n<tr>\n<td><span style=\"font-weight: 400;\">Alaska<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Arizona<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Arkansas<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Connecticut<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Delaware<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Hawaii<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Illinois<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Kansas<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Louisiana<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Mississippi<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Nebraska<\/span><\/td>\n<td><span style=\"font-weight: 400;\">New Mexico<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">New York<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Oregon<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Tennessee<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Utah<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Virginia<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Washington<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"font-weight: 400;\">In California, there are 4 counties that have mandated the use of IIDs on all offenses with BACs of .08 or higher: <\/span><i><span style=\"font-weight: 400;\">Alameda, Los Angeles, Tulare and Sacramento<\/span><\/i><span style=\"font-weight: 400;\">. In other counties of California though, the use of IIDs is discretionary.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are 18 states that require the use of IIDs only on <\/span><span style=\"font-weight: 400;\">repeat<\/span><span style=\"font-weight: 400;\"> offenses (2<\/span><span style=\"font-weight: 400;\">nd<\/span><span style=\"font-weight: 400;\">, 3<\/span><span style=\"font-weight: 400;\">rd<\/span><span style=\"font-weight: 400;\">, etc). Those states are:<\/span><\/p>\n<table>\n<tbody>\n<tr>\n<td><span style=\"font-weight: 400;\">Alaska<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Georgia<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Kentucky<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Massachusetts<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Michigan<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Minnesota<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Missouri<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Oklahoma<\/span><\/td>\n<td><span style=\"font-weight: 400;\">New Jersey<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">North Carolina<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Montana<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Pennsylvania<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Rhode Island<\/span><\/td>\n<td><span style=\"font-weight: 400;\">South Carolina<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Texas<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">West Virginia<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Wisconsin<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Wyoming<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"font-weight: 400;\">Of these 18 states, 8 of them do require the use of IIDs on a first offense <\/span><span style=\"font-weight: 400;\">if<\/span><span style=\"font-weight: 400;\"> the offender has a BAC of .15 or higher: Kentucky, Minnesota, New Jersey, North Carolina, Rhode Island, West Virginia, Wisconsin, and Wyoming.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">FL and MD \u2013 Step it Up!<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Florida and Maryland also require the use of IIDs for drivers with a BAC of .15 or higher. These two states though have no other requirements for the use of IIDs. That is, a person can have 2 or 3 DUI convictions and, as long as all are under .14 BAC, they will not be required to use an IID (boo!).<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Discretionary Use of IIDs<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">There are 11 states, and also the District of Columbia, that make the use of an IID device discretionary based on the offenders choice (like regaining driving privileges during a license suspension period) or by court order based on a judges, well, judgment. These states are:<\/span><\/p>\n<table>\n<tbody>\n<tr>\n<td><span style=\"font-weight: 400;\">California*<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Colorado<\/span><\/td>\n<td><span style=\"font-weight: 400;\">D.C.<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Idaho<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Indiana<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Iowa<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Maine<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Nevada<\/span><\/td>\n<td><span style=\"font-weight: 400;\">North Dakota<\/span><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Ohio<\/span><\/td>\n<td><span style=\"font-weight: 400;\">South Dakota<\/span><\/td>\n<td><span style=\"font-weight: 400;\">Vermont<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"font-weight: 400;\">It goes without saying that these 11 states and D.C. should reconsider their position on the use of IIDs. Even the NHTSA has <\/span><a href=\"http:\/\/www.nhtsa.gov\/About+NHTSA\/Press+Releases\/U.S.+Department+of+Transportation+Announces+%27Drive+Sober+or+Get+Pulled+Over%27+Holiday+Crackdown\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">released statements<\/span><\/a><span style=\"font-weight: 400;\"> that encourage states like these to revise and update their IID requirements.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you feel that your state\u2019s laws aren\u2019t tough enough or are not being properly enforced, get involved with groups like Mothers Against Drunk Drivers (<\/span><a href=\"http:\/\/www.madd.org\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">MADD<\/span><\/a><span style=\"font-weight: 400;\">), Teens Against Drunk Driving (<\/span><a href=\"http:\/\/tadd.org\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">TADD<\/span><\/a><span style=\"font-weight: 400;\">), and Fathers Against Drunk Driving (<\/span><a href=\"http:\/\/www.faddintl.org\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">FADD<\/span><\/a><span style=\"font-weight: 400;\">).
